1. Information Pulzzy may handle

Depending on the features you choose to use, Pulzzy may handle information you provide directly, such as your name, profile image, conversation prompts, contact details, feedback, and messages you send to us. We may also receive basic technical information generated by your device or browser, such as device type, operating system, app version, IP address, browser information, timestamps, and diagnostic or security information.

Pulzzy is designed for people who are physically nearby at a shared event, venue, or gathering. To support nearby discovery, the app may use Bluetooth and related device permissions. Bluetooth signals and proximity information are not precise GPS coordinates. We do not represent that proximity technology is error-free, continuously available, or capable of confirming any person’s identity or exact location.

2. How we use information

We may use information to operate, provide, maintain, secure, and improve the Services; show the information you elect to share with relevant nearby users; respond to support requests; prevent fraud, abuse, and unsafe activity; comply with law; and protect the rights, property, safety, and security of Pulzzy, users, and others. We may also use aggregated or de-identified information for these purposes where permitted by law.

3. What other people can see

Information you choose to place in your Pulzzy profile or otherwise make visible through the Services may be seen by other users who meet the app’s proximity or event conditions. Think carefully before sharing personal, sensitive, or identifying information. Pulzzy cannot control what another person does with information they see, hear, save, photograph, repeat, or share outside the Services.

4. When information may be disclosed

We may disclose information to service providers that help us operate the Services, subject to appropriate contractual safeguards; when required or permitted by law; in response to valid legal process; to protect against fraud, security threats, or harm; and in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets. We may also disclose information with your direction or consent, and may use or disclose aggregated or de-identified information where allowed by law.

5. Your choices

You can control certain app and browser permissions, including Bluetooth, through your device settings. Turning off a permission may limit or prevent nearby-discovery features from working. You may contact us at hello@pulzzy.com to request access, correction, or deletion of personal information, subject to applicable law, verification, and lawful exceptions. We may retain information when necessary for legitimate business, legal, security, fraud-prevention, dispute-resolution, or recordkeeping purposes.

6. Data security and retention

We use reasonable administrative, technical, and organizational measures designed to protect information. No method of transmission, storage, Bluetooth communication, or electronic system is completely secure, however, and we cannot guarantee absolute security. We retain information only for as long as reasonably necessary for the purposes described in this Policy, unless a longer period is required or permitted by law.

7. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to Pulzzy, please contact us so we can take appropriate action. Where a higher minimum age applies under local law, the Services are not directed to people below that age.

8. Third-party services

The Services may contain links to or interact with third-party services, events, venues, networks, devices, or platforms. Their privacy practices and terms are their own. Pulzzy is not responsible for third-party content, conduct, security, availability, or privacy practices. Please review their policies before providing them information.

9. In-person interactions and assumption of risk

Pulzzy facilitates introductions; it does not screen, verify, endorse, employ, supervise, or control users, venues, events, or third parties. Any decision to communicate with, meet, approach, interact with, or share information with another person is your own decision and at your own risk. Use good judgment, follow venue and event rules, and seek immediate assistance from local emergency services or venue staff if you feel unsafe.

10. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR THAT USERS OR PROXIMITY RESULTS ARE WHO THEY APPEAR TO BE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PULZZY AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, BUSINESS, OPPORTUNITY, PERSONAL PROPERTY, OR PERSONAL INJURY ARISING OUT OF OR RELATED TO THE SERVICES, USER CONTENT, PROXIMITY TECHNOLOGY, OR ANY INTERACTION WITH A USER OR THIRD PARTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PULZZY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PULZZY FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in this Policy excludes liability that cannot lawfully be excluded.

11. Changes to this Policy

We may update this Policy from time to time. The “Last updated” date indicates when it was most recently revised. Your continued use of the Services after an updated Policy becomes effective means you acknowledge the updated Policy to the extent permitted by law.
